Terms of service

This agreement constitutes a rental contract for cinematographic equipment, accessories, and other related items (equipment – products) between Ioannis Lefakis - Vasileios Parousis "FILMA" (the Supplier) and the Lessee or the natural person who signs and receives the equipment, acting as a representative on behalf of, by order of, or in the name of the Lessee (Signatory or Recipient), affirming that they are duly authorized to accept this agreement.

Article 1. GENERAL TERMS

  1. This agreement becomes effective upon the placement of an order via the internet or by telephone, as well as upon the issuance of any type of document by the Supplier. This agreement is non-transferable to third parties and does not constitute or establish any right of ownership, modification, transfer, or alteration of any real or tangible property rights.

  2. The maximum rental period is set at three (3) weeks from the order date, subject to the acceptance of this agreement's terms.

  3. The Supplier unilaterally reserves the right to terminate this contract while maintaining all its legal rights.

Article 2. RENTAL CHARGES – GENERAL OBLIGATIONS

  1. The charges are specified in the invoice and/or the delivery note – private agreement and are fully recognized and accepted by the Lessee. These charges cannot be disputed at any time. The rental period starts as defined in these documents.

  2. All deliveries and returns (successful or unsuccessful) shall be at the expense of the Lessee or the Signatory. Once the ordered equipment leaves the Supplier’s premises (by van or other means), the Supplier bears no responsibility for the equipment.

  3. If the Lessee makes payment via credit/debit card by signing in blank, they irrevocably authorize the Supplier to collect the confirmed outstanding amount. Partial payments via credit/debit card are also considered as an irrevocable method of payment.

  4. Upon the order's completion, the Supplier collects 100% of the rental value.

  5. In case of damage to the equipment, the Lessee is responsible for its repair and covers all related repair costs. The Supplier shall immediately undertake the repair process.

  6. In case of loss or destruction of the equipment, the Lessee is responsible for full compensation, covering both direct and consequential damages, and waives any objections or claims regarding damage restoration. The Lessee must replace the equipment (as listed in the respective Delivery Notes, Receipts, or Service Invoices) within one (1) business day. Otherwise, the Supplier is entitled to proceed with the immediate replacement of the equipment at the Lessee's expense.

  7. In case of theft, the Lessee is responsible for full compensation for any direct or consequential damages, waiving any objections or claims regarding damage restoration. The Lessee must notify the local law enforcement authorities and provide the Supplier with a certified copy of the related police report. Otherwise, each day the equipment is missing will be considered a delay and will incur the corresponding charges. Replacement must occur within one (1) business day, failing which the Supplier may proceed with the replacement at the Lessee’s expense.

  8. Upon rental termination, the Lessee must return the equipment. The return is validated   by the issuance of a Delivery Note by the Supplier upon receipt of the equipment or by the Receipt Confirmation issued by the affiliated courier company upon collection from the Lessee.

  9. The Lessee may not sublease, sell, or transfer the equipment for use to any third party, whether a business entity, legal entity, or individual.

  10. The Lessee is responsible for the security, proper use, maintenance, and cleanliness of the equipment. Any issues must be reported to the Supplier immediately.

  11. The Supplier reserves the right to modify its pricing policy (rental prices, offers) at any time. Confirmed agreements and reservations prior to any such modifications remain unaffected.

  12. The Lessee is responsible for obtaining all necessary permits for the use of the equipment in specific locations or countries and agrees to comply with all local and international legal requirements

Article 3. DELIVERY AND RETURN

  1. The tenant must return the equipment they have rented to the supplier's headquarters (VAN vehicle) no later than the end of the day that was predetermined during the rental. In any other case of delay, the tenant will be charged with the corresponding fees. A Delivery Note issued by the supplier upon the return of the equipment by the tenant is considered proof of return.

  2. If the Lessee exceeds the agreed rental period, additional charges will be calculated based on the daily rental rate multiplied by the number of delay days.

  3. The Signatory or Recipient acknowledges upon collection that they have been informed about the safe and proper use of the equipment. They explicitly declare that the equipment will be used only by themselves or by individuals who have received clear instructions.

  4. If the Lessee receives damaged, defective, or incomplete equipment, they must inform the Supplier within two (2) hours of receipt. The collection time is determined by the time indicated on the related delivery note issued by the courier company. Otherwise, the equipment is deemed to be in perfect condition.

  5. The Lessee is responsible for selecting the appropriate equipment for use.

Article 4. SUPPLIER’S RESPONSIBILITIES

  1. The Supplier is not liable for any consequential damage or financial loss, including loss of business credibility, due to delayed or failed delivery, removal of the equipment/products after delivery, their unsuitability, destruction, or operational failure. The Supplier reserves the right to replace the equipment with products of similar specifications or functionality.

  2. This agreement is governed by Greek law, and the competent courts for any disputes are those of Athens. Compliance with the above terms is mandatory. The Supplier reserves the right to amend this agreement with prior notice before or during the rental period, which shall form an integral part of this contract.

  3. The Supplier is not responsible for any data or recorded media remaining on the rented systems. The Lessee is obliged to delete any data before returning the equipment.

  4. The Lessee is committed to maintaining the confidentiality of the material they film and to respecting the intellectual property rights of the Supplier and the clients.

  5. On-site technical support is available for urgent troubleshooting and repairs, with additional costs determined based on the Lessee's needs.
